Introduction 

This privacy policy sets out how we, Mindhive Limited, trading as Mindhive Global (Mindhive), collect, store, use and disclose your personal information when you use or interact with our website (https://mindhiveglobal.com/) (Website), access and use our services (Services) and where we otherwise obtain or collect information about you. Personal information is information that relates to an identified or identifiable individual (Personal Information).

Mindhive Limited is a company incorporated in New Zealand, with its registered office in Auckland.

When handling personal information we will comply with all privacy laws that we are legally obliged to comply with (Applicable Privacy Laws), including (as applicable), the New Zealand Privacy Act 2020, the Australian Privacy Act 1988,  the General Data Protection Regulation (EU) 2016/679 (EU GDPR) and/or the United Kingdom Data Protection Regulation (UK GDPR).

Changes to this policy 

We may change this policy by uploading a revised policy onto the Website. The change will apply from the date that we upload the revised policy. 

Who do we collect your personal information from? 

We collect Personal Information, including names, IP addresses, contact information), browser information and interactions an individual has with our Website or Services. We collect this information from:

  • you, when you provide that Personal Information to us, through use of our Website and/or the Service, or through any other interactions with us (e.g. in person, via telephone, email or otherwise).
  • third parties, where you have authorized this or the information is publicly available.
  • use of the Website and/or Services, e.g. any action an individual takes while using our Website or Services. We use this information to provide the Website and Services, understand what content and features are effective and improve our Website and/or Services. 

We do not purposefully collect or process sensitive information. You must not provide us with any sensitive Personal Information.

We do not knowingly collect any Personal Information from children under the age of 18. If you think that your child provided this kind of information on our Website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.

Providing your Personal Information and allowing us to use it in accordance with this privacy policy is optional. However, if you choose not to provide necessary Personal Information, we may be unable to provide you with certain Services.

If possible, we will collect personal information from you directly. However, we may receive Personal Information about you from a third party (including via publicly available sources), and by accessing and using the Website or Services you will be deemed to have authorised such third parties to provide us with this information.

If you provide us with personal information about another person, you confirm that:

  • they have authorized you to do so;

  • they have been made aware that their personal information will be provided to us and that it may be accessed, used and/or disclosed by us in accordance with this privacy policy; and

  • they have been made aware of this privacy policy, including their right to access and correct their personal information in this privacy policy.

How do we use your personal information?

We will not process Personal Information, other than as outlined in this privacy policy, without having a lawful basis to do so.

We process Personal Information: 

  • to provide our Website and Services and otherwise carry out our obligations under our contracts with our service providers, licensors and customers;
  • to communicate with you, other users of the Website and Services, and other customers, licensors and suppliers relating to the Website and Services, including for administration purposes, such as customer service or system maintenance;
  • to invoice for the Services and collect money owed to us, including authorizing and processing credit card transactions;
  • to comply with our obligations to our third-party data and service providers, suppliers and other users of our Website and Services;
  • to send our users marketing and promotional messages and other information that may be of interest where they have consented to receiving such material. You can opt out of receiving marketing materials from us by using the opt-out facility provided (e.g. an unsubscribe link) or by emailing us at marketing@mindhiveglobal.com;
  • to improve our Website and Services;
  • to analyze usage of the Website and Services or carry out research and analysis, so we can improve the Website and Services;
  • to respond to due diligence requests and/or transfer Personal Information in the case of a sale, merger, consolidation, liquidation, reorganisation or acquisition of our business;
  • to protect and/or enforce our legal rights and interests, including defending any claim; and
  • to comply with our legal obligations, including any notification and reporting obligations and any access directions imposed on us by a Government agency or regulatory authority.

We may also use Personal Information collected for such other purposes that are compatible with the original purpose described above, or that the relevant individual has otherwise consented to from time to time.

We may anonymize and aggregate information such that no person could be re-identified from the information. This aggregated and anonymized data is not Personal Information and this privacy policy does not apply to it.

If you are based in the European Union or the United Kingdom at the time we are processing your Personal Information, you have the right to object to the way we process your Personal Information where the processing is based on legitimate interests. 

Disclosing your personal information   

We may disclose Personal Information to:

  • service providers, licensees, partners and suppliers who provide necessary data, goods and/or services to us or help us market and sell the Service;
  • third parties, as necessary to provide the Website and Services;
  • any business that supports us, including hosting or maintaining any underlying IT system that we use to provide our Website and/or Services;
  • other third parties to anonymize and aggregate statistical information;
  • respond to due diligence requests and/or transfer your information in the case of a sale, merger, consolidation, liquidation, reorganization or acquisition of our business; and
  • a person who can require us to supply Personal Information (e.g. a regulatory authority or law enforcement agency); and
  • any other person or entity that we have been validly authorized to disclose information to. 
International transfers

Mindhive is located in New Zealand, so your Personal Information may be transferred and/or stored there. For the purposes of the EU GDPR and the UK GDPR, New Zealand has been recognized as providing adequate protection.

We use the services of entities in various countries (including, New Zealand, Brazil, Mexico, United States of America, Germany, Italy, United Kingdom, South Africa, Japan, Australia). Consequently, we may transfer Personal Information to parties located in these countries.  Although we will endeavour to ensure that Personal Information is treated securely and in accordance with this privacy policy as well as Applicable Privacy Laws, we advise that some of these countries may not have an equivalent level of data protection laws as those in New Zealand. 

Third party services

We use third party services for providing the Website and Services, to ensure a better experience for users and for improving the Website and Services. In the process of doing so, the third party service provider may have access to Personal Information. However, these third parties do not have the right to use the Personal Information for their own use.

Protecting your personal information   

We will take reasonable steps to keep your Personal Information safe from loss, unauthorized activity, or other misuse.

Internet use   

While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk.

If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal information. We suggest you review that site's privacy policy before you provide personal information.

How long we keep your personal information

We will keep Personal Information:

  • until we no longer have a valid reason for keeping it;

  • until the relevant individual requests us to stop using it; or

  • or as long as required by law e.g., we keep invoice information for 7 years to fulfil our tax obligations.

When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize such information, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.
